Guardianship Attorney - Veterans Affairs - Baltimore, MD
Description

The Gilchrist Law Firm has a great job opportunity to provide legal representation for the Veterans Affairs Maryland Health Care System (VAMHCS) in filing and managing guardianship cases for Veterans who lack capacity to make decisions for themselves and do not have family members able or willing to act on their behalf regarding healthcare and financial affairs.

Responsibilities:

  • File guardianship petitions to the Circuit Court of Maryland on behalf of VAMHCS within 14 days of receiving necessary physician certificates.
  • Submit notifications to all interested parties related to the petition within 5 business days to comply with legal requirements.
  • Represent VAMHCS in all court hearings related to guardianship petitions.
  • Ensure VAMHCS staff required to testify are fully prepared and informed about the case details and legal proceedings.
  • Provide copies of all records and court filings to VAMHCS within 2 business days of filing.
  • Collaborate with VAMHCS program staff to ensure access to medical records and expert testimony as required.
  • Provide weekly status reports on each petition case to keep VAMHCS informed of case progress.
  • Comply with the VA Patient’s Bill of Rights (Section 17.34a, Title 38, CFR) and other legal and ethical standards set by the VA and the Circuit Court of Maryland.
  • Submit invoices in a timely manner in accordance with the Prompt Payment Act and VA’s billing protocols.
Requirements
  • Juris Doctor (JD) degree from an accredited law school. 
  • Active license to practice law in the state of Maryland. 
  • Experience with guardianship or elder law cases, ideally with a focus on healthcare or financial decision-making. 
  • Knowledge of Maryland Circuit Court procedures and compliance with VA regulations.
