The Position:
The Senior Counsel, Employment and Litigation advises the Company regarding legal issues stemming from the employer-employee relationship. Counsel helps to identify legal risk stemming from the Company’s employment practices and assist in the development of policies and practices to mitigate legal risks and support compliance with applicable laws. This attorney also collaborates with the Legal team to manage pre-litigation and litigation matters. Responsibilities include:
- Provide practical and business-oriented legal advice and counseling on a range of employment issues, including hiring, performance management, employee relations, terminations, leaves of absence and accommodations, wage and hour, internal investigations, compensation, benefits, and privacy.
- Facilitate competitive hiring of highest qualified staff subject to compliance with legitimate obligations to former employers, including enforceable non-competition, non-solicitation and confidentiality obligations.
- Drafting, revising and reviewing employment-related contracts, agreements, severance agreements, releases, policies, procedures, training materials, and other written materials and handbooks in collaboration with the Human Resources department.
- Handling administrative and arbitration matters, such as responses to government agency audits and investigations (including Equal Employment Opportunity Commission, Department of Labor and State employment agency matters).
- Oversee, direct and provide employment legal advice with respect to internal investigations.
- Investigate, negotiate and resolve pre-litigation claims and administrative charges, and serve as subject matter expert for employment litigation matters.
- Collaborate with outside counsel to advise Human Resources and management on employment issues.
- Manage employment related litigation, including responding to attorney demand letters, effectively negotiating resolution of claims, and making recommendations to Human Resources and senior management on corrective action, with support from outside counsel where appropriate.
- Facilitate enforcement of employee obligations to Company upon termination of employment including compliance with legitimate/enforceable terms of non-competition, non-solicitation and confidentiality agreements with the Company.
- Actively monitor employment law changes and Company practices, in collaboration with the Human Resources department and senior management, to ensure policies and practices are compliant; and
- Collaborate with Human Resources and senior management to support inclusion and diversity initiatives within the Company.
- Collaborate with business teams to respond to regulatory agency/professional board inquiries, including response to document production/subpoenas.
- Collaborate with and advise business teams in other areas of risk management, pre-litigation, and litigation matters, together with inhouse legal team and outside counsel resources, including:
- Implementation of litigation holds, with paralegal support.
- Preparation of timelines and supporting documentation.
- Managing litigation deliverables, identifying and mitigating risks and action plans, together with paralegal support and inhouse/outside counsel support.
- Drafting simple settlement agreements where appropriate or reviewing settlement agreements if prepared by outside counsel.
- JD degree from an accredited law school
- Bar admission in the US
- Min 5-7 years’ experience in employment and benefits law
- Litigation experience preferred
- Health care experience preferred

- Possess strong client-relations and interpersonal skills, as well as excellent judgment and superior written and oral communication and analytical skills
- Ability to juggle and prioritize multiple time-sensitive tasks effectively and independently
- Strong ability to work collaboratively within the Legal Department and across other departments
- Ability to communicate legal concepts in a digestible manner for business leaders
- Ability to help internal clients navigate legal issues to support both the business goals and the best interests of the Company
