Attorney - Landlord/Tenant & Real Estate
Description


Coughlin & Gerhart, LLP is seeking a full-time experienced and dedicated New York State admitted attorney to handle Landlord/Tenant matters.  This position would be based out of our Binghamton, New York office.


Coughlin & Gerhart proudly dates back to the 1890s and has grown to include seven offices in New York and one in Pennsylvania. As we continue to grow, we remain committed to our founding principles as a law firm focused upon client relationships and our dedication to fully meeting the needs of our individual, business, and municipal clients. 


RESPONSIBILITIES:


1.  Represent clients, primarily property owners, landlords, and property managers, in landlord-tenant disputes, eviction proceedings, and real estate transactions. Provide legal advice on property management issues, lease agreements, and tenant rights.


2.  Conduct thorough legal research on landlord-tenant law, real estate regulations, and property-related issues, with a focus on the rights of property owners, landlords, and property managers. Analyze case law, statutes, and regulations to build strong legal arguments.


3.  Draft, review, and revise legal documents including lease agreements, eviction notices, settlement agreements, and real estate contracts. Ensure all documents are legally sound and in the best interest of the clients. 


4.  Negotiate settlements and mediations between parties to resolve disputes amicably and efficiently. Advocate for clients’ interests during settlement discussions and court proceedings.


5.  Represent clients in state and local courts, primarily representing property owners, landlords, and property managers in summary eviction proceedings. Court representation includes preparing and presenting arguments, examining witnesses, and managing evidence.


6.  Provide expert legal counsel to clients, explaining their rights and obligations as property owners, landlords, and property managers under the law. Offer strategic advice to help clients make informed decisions regarding their real estate matters and properties.


7.  Ensure compliance with all relevant laws, regulations, and legal procedures. Identify and mitigate potential legal risks associated with real estate transactions and landlord-tenant issues.


8.  Manage a caseload efficiently, including maintaining accurate case records, meeting deadlines, and ensuring timely communication with clients and opposing counsel.

5.  Demonstrated ability to handle complex legal issues with professionalism and integrity. 


Requirements

 

QUALIFICATIONS:


1.   Juris Doctor (JD) degree from an accredited law school.


2.   Admission to the state bar in New York and in good standing.
