The Jury Consultant is responsible for providing jury research and consulting services including consultation with clients on case analysis and themes, jury research projects, witness preparation activities, voir dire and jury selection, consultation on visual persuasion, opening statements, and closing arguments.
Responsibilities
Jury Consulting responsibilities are Jury research, analysis of qualitative and quantitative data, preparation of research reports, consulting with trial attorneys and witnesses, and development of research methods and procedures.
A Jury Consultant works in cooperation with the trial team to develop trial strategy and case presentations. Engagements often begin with case briefing and theme development where the jury consultant helps to identify and refine case themes and issues that will resonate with jurors in a particular trial venue. Often, this work occurs with the assistance of graphics consultants who have expertise in developing visual representations of case themes and evidence. These case presentations are then tested in a focus group and mock trial research where mock jurors provide an assessment of the presentations as they discuss and deliberate the case. The findings from this research enable the consultant to provide recommendations for further refinement of case presentations.
When cases proceed to trial, Jury Consultants work with the lawyers to help prepare witnesses so they will provide clear and concise testimony. Jury Consultants also work with the lawyers to develop questions for voir dire and assist in the jury selection process. The Jury Consultant may also monitor the trial and provide feedback to lawyers about the clarity and persuasiveness of the evidence and witness testimony.
