The Director of Tax, Regulatory Affairs and Treasury is responsible for: tax and regulatory reporting and compliance; corporate liaison for all legal activities and shared support in performing treasury functions. This position ensures tax and regulatory compliance for our business operations domestically and responsible for the coordination and execution of all transfer pricing activities and functions.

Serving as the Director of Tax, all State license registrations will be completed, executed and managed by the Director. Every tax return will be reviewed and as required, signed by the Director.

This role serves as a business partner for the executive team and managers within the organization. Service includes keeping them informed of changing tax and regulatory requirements; sharing the impact it may have on the business; establishing, implementing and executing processes to ensure Davidoff of Geneva's ("Company") compliance. This is possible with the Director's deep understanding of the characteristics and categorization of our tobacco products depending on tax authority regulation and definitions.

This position requires a person with excellent research, analytical and organizational skills; critical thinking, detail oriented, strong presentation and communication skills.

  

Tax Reporting and Compliance

State Sales and Tobacco Tax Licensing and Reporting

  Our B2B ERP system is SAP. We have customized RICEFs for our Tax Manager to have the data required for State tobacco tax reporting associated with tobacco tax license management. The Director needs to be committed to developing a deep expertise in state tobacco licensor rules by analyzing regulations with consideration for customer business models and our corporate structure. This knowledge is foundational to managing requirements for company license, customer license and reporting.

 Our B2C e-commerce platform is Big Commerce. It includes IGEN, a cloud-based tax calculation system for multi-state tobacco and sales tax reporting services. The Director is required to monitor tax law development by participating in a monthly call with an Industry association, industry legal counsel and an industry consultant responsible for monitoring state e-commerce excise tax collection, tobacco control, licensure and reporting activities and issues pertaining to possible impacts on Model Legislation Project and related bills or regulations.
  Our B2C brick and mortar retail ERP system is LS retail. It includes Avalara / Evoort Solutions, a cloud-based tax calculation system for multi-state tobacco and sales tax reporting services. The Director is the primary contact responsible for the vendor relationship and works closely with FP&A regarding master data. 

Corporate Income Tax

Intimate knowledge of the corporate tax issues facing a multinational US company (not publicly traded) especially in the areas of tax compliance, and tax accounting. 

 Maintain position of multi-state PL 86-272 election. Recognize changes within the organization that create an economic presence, confirm with external tax consultants, discuss with Head of Finance before approving filing decisions. Once approved, establish Economic Factor for Apportionment.

 Maintain the tax trial balance with emphasis on transactions impacting annual tax provision, return-to-provision differences, quarterly tax estimates, paid in capital or dividends. On an annual basis, create US Consolidation from year-end tax trial balances with proper investment and equity roll forward. Provide accounting team with journal entries to ensure proper recording on tax ledger.

Prepare annual income tax provision workbook, drive year-end deadlines for deliverables with FP&A and accounting team to obtain, sales by state, fixed asset roll forward, related additions and retirements. Submit to external tax team for review. Upon completion of their recommended tax calculations, give accounting team journal entries for book and tax ledger. Prepare and submit required information to Swiss parent company's Tax Director.
  Review Form 1099s prepared by accounting team for appropriateness and accuracy. Update Form 5472 schedules, Transfer Pricing Information. Prepare Section 263A UNICAP calculation for review by external tax team.
 

Effectively manage federal and state income tax return process including annual returns, quarterly estimates with outside advisors. Arrange and manage audits as required. Update Accumulated Earning and Profits (E&P) for consideration of dividend.

 
Regulatory Affairs – Reporting and Compliance  

 The Company is a US importer of tobacco products. Monthly reporting is required with two Federal entities: Department of Treasury: Alcohol and Tobacco Tax and Trade Bureau using Form 5220.6 based on CBP Form 7501; and the Food and Drug Administration (FDA) Form 3852 which is the basis for User Fees. This role requires managing User Fees which is based on knowledge and understanding of FDA tobacco regulation effective 2016.

Corporate Liaison – Legal Activities 

 Handle confidential records and ensure corporate governance compliance by maintaining the contract repository for each US corporate entity. The repository includes Board of Director minutes, Engagement Letters, Secretary of State filings, non-Disclosure agreements, and General Service / Schedule of Work agreements. This list serves as an example of the types of documents maintained.


Primary contact with external legal counsel for coordination. Responsible for the review of monthly legal invoices.
  

Treasury Functions

 As a Director within the Finance Team, this role contributes to the enforcement of our dual-approval controls policy. All disbursements and any creation, modification, or activation of cash templates require two independent authorized approvers with no conflicting duties. This is to reduce fraud, strengthen segregation of duties, and ensure regulatory and audit compliance across treasury and accounts p`ayable processes. This role is also responsible for treasury management inclusive of cash forecasting, cash management, debt and financing, investments, and banking relationships.

 

In order for this role to file and pay via Federal and State portals without dual approval, it is critical that prior to any payment the tax filing is supported with a filed tax return or adequate documentation from external tax consultant. All supporting documentation for payments must be submitted to Accounts Payable within 24 hours and to the team member managing the daily bank sheet.

Requirements

     

REQUIRED SKILLS AND KNOWLEDGE

· Uphold Code of Ethics. Build and maintain trust of internal and external stakeholders. Involved with details knowing appropriate way to delegate. Flexible, mature team-player with the ability to be decisive.

· Proven skill in interpreting excise tax regulations and applying them to specific product attributes.

· Strong analytical and organizational skills. 

· Acute understanding of business process flows and related internal controls. 

· Intermediate working knowledge of Excel, utilizing tools like VLOOKUP and PivotTables.

     

SUPERVISORY RESPONSIBILITIES 

This position is responsible for the Tax Manager.    


EDUCATION and/or EXPERIENCE 

· Bachelor's degree in accounting with at least 5 years of experience in accounting / tax compliance within a public accounting firm and/or an international company.

· Minimum 10 years of experience with progressively increasing responsibilities.

· Strong knowledge of corporation income tax, ASC 740 accounting for income taxes, tax forecasting, and tax planning, with experience overseeing third-party tax preparation firms and ensuring timely, accurate tax compliance and financial reporting.

· Industry experience in premium cigar / popular price cigar industry or a similarly regulated industry is a plus.
