The Bernstein Companies and its affiliates (“TBC”, “we”, “us”, or “our”) are committed to protecting your privacy and the responsible management, use, and protection of your personal data.  This Recruitment Privacy Notice (“Notice”) describes our practices in connection with the information that TBC, or other affiliates of TBC collect about you online or offline in connection with your job application and future career opportunities with TBC.  In case of a conflict between this Notice and applicable law, applicable law will govern.   
 

This Recruitment Privacy Notice only applies to the personal data of job applicants, potential candidates for employment or partnership, and those who participate in our recruiting programs and events.

 

By submitting your personal data to us, you acknowledge that: 

  • You have read  and understood this Notice and agree to the use of your personal data as set out herein.
  • You are not required to provide any requested information to us, but your failure to do so may result in us not being able to continue your candidacy for the job for which you have applied.
  •  All of your representations are true and correct to the best of your knowledge and belief, and you have not knowingly omitted any related information of an adverse nature.  Providing any inaccurate information may make you ineligible for employment. 
  • This Notice  does not form part of any contract of employment offered to candidates hired by TBC.
     

1.  INFORMATION WE COLLECT

  • Contact Information including name, address, telephone numbers, e-mail address, and any other contact information.
  • Previous work experience, compensation, education, degrees, and any other employment-related information.
  • Professional and other work-related licenses, permits, certifications, skills, languages, and other competencies.
  • Reference information you provide relating to work references.
  • Online Account Information such as username and password to access the TBC career page sites, application identifiers, internet      protocol (IP) address and device identifiers that may be automatically collected.
  • Work authorization status and relevant visa or other immigration information.
  • Information from social media sites linked to your application
  • Any other information you elect to provide to us (e.g., employment preferences, willingness to relocate, current salary, desired salary, awards or professional memberships).  

Sensitive Personal Information

Certain types of information are considered sensitive personal information in certain jurisdictions. This includes the following: information on race, religion, ethnicity, nationality or national origin, age, gender identity, sex, life or sexual orientation, criminal convictions and offenses, marital status, medical or health information (including disability status), genetic or biometric information, religious or philosophical beliefs, political party or trade union membership, background check information, and veteran status.

 

As allowed by applicable law, we may ask questions about your race/ethnic origin, gender, and disability (“Diversity Information”), for the monitoring of equal employment opportunity. We may also inquire about criminal records (“Criminal Records”) following a conditional offer of employment, where permitted by applicable law.  Except as specifically requested or legally required, we ask that you avoid submitting information in your application which may be deemed as sensitive information. Sensitive information includes data about your race, religion, ethnicity, nationality or national origin, age, gender identity, sex life or practices or sexual orientation, marital status, medical or health information (including disability status), genetic or biometric information, political or philosophical beliefs, political party or trade union membership, veteran status, photographs, background check information, judicial data, such as criminal records or information on other judicial or administrative proceedings.

 

2.  How We Use Information
 

We use your personal data for the following human resources and business management purposes:

  • Evaluate qualifications for the job you applied for or future jobs that may match your profile.
  • Communicate with you regarding your application, inquiries and requests, other job openings and important notices.
  • Verify your information and conduct reference/background checks, if you are offered employment.
  • Ensure compliance with applicable legal and regulatory requirements.
  • Maintain records in relation to recruiting and to improve our recruitment processes.
     

3.  Accuracy of Information Provided


    Any information you submit through TBC ‘s career site or which you otherwise share with us must be true, complete, and not misleading.  Purposely submitting inaccurate, incomplete, or misleading information may lead to rejection of your application during the application process or, if identified after employed, disciplinary action including immediate termination of employment.  In addition, it is your responsibility to ensure that information you submit does not violate any other person’s rights. If you provide us with personal information of a reference or any other individual as part of your application, it is your responsibility to obtain consent from that individual prior to providing the information to us. By providing personal information of another individual, you are affirming that you have obtained such consent.


4. How We Share Your Information


    We may share your data with:

  • Internal HR and hiring teams.
  • Third-party service providers (e.g., background check providers) that we believe need the information to perform technology, business, or other professional functions for us including providing products or services to you on our behalf, creating or maintaining our databases, researching and analyzing  the people who request information from us, preparing and distributing      communications, or responding to inquiries.   
  • We may share your information with affiliate companies that we own or control, that are owned or controlled by us, or that are under common ownership or control for legitimate business purposes.
  • If TBC, or any portion of our assets, are acquired by, merged with, transferred to, or invested in by another company, we may share your personal information with that company or other third parties involved in the business transition. We cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your information the same as described in this Notice. 
  • We share information where necessary to comply with applicable law, to respond to requests from law enforcement agencies or other government authorities or third parties, as permitted by law, and without your consent when it is necessary to protect  our customers, employees, or property; in emergency situations; or to enforce our rights under our terms of service and policies. 

5. Data Retention & Disposal

 

We retain information as long as necessary to fulfill the purposes for which we collected it, for legitimate business reasons, or as required by law.  We may need to keep your data for longer than our specified retention periods to honor your requests, including to continue keeping you opted out of marketing emails, or to comply with legal or other obligations.  When we dispose of information, we use secure means, such as either physically or electronically erasing information or making it anonymous in a non-recoverable manner.
 

6.  Security


We implement appropriate standards of technical, physical, and operational security to secure your personal data from loss, misuse, unauthorized access, disclosure, or destruction.  Only authorized personnel of TBC and of our third-party service providers are permitted to access personal data, and these personnel and third-party service providers are required to treat this information as confidential.  Despite these precautions, no data transmission or storage system can be guaranteed to be 100% secure. 7.  Your Rights


We take reasonable steps that are designed to keep your personal data accurate, complete, and up to date for the purposes for which it is collected and used.  We also have implemented measures that are designed to help ensure that our processing of your personal data complies with this Privacy Notice and applicable law.


Subject to applicable law, including exceptions, you have the following rights with regard to the personal data that we collect about you:

  • right to request a copy of the personal data that we hold about you.
  • right to request that we correct or otherwise amend your personal data if it is not correct or otherwise not complete, timely, and accurate for the purposes for which we are using it.
  • right to request that we cease processing or restrict or limit the processing of your personal data.
  • right to withdraw your consent to our processing of your personal data where the basis of our processing is your consent.  This right may not apply if there  are other legal justifications to continue processing or we need to retain certain personal data where required or permitted under applicable law.
  • right to not be discriminated against for exercising your individual rights regarding your personal data.
