SMS Privacy Policy


1. Purpose of This Policy

This SMS Privacy Policy explains how L2 Brands (“the Company”) collects, uses, stores, and protects personal information obtained from employees, job applicants, contractors, or other individuals (“Users”) through SMS/text messaging.


2. Consent to Receive SMS Messages

By providing a mobile phone number to the Company, Users consent to receive SMS messages related to:

  • Work schedules, shift changes, and attendance
  • HR announcements and employment-related notices
  • Emergency or safety alerts
  • Payroll, benefits, and administrative communications
  • Recruitment and onboarding updates (for applicants)

Users may withdraw consent at any time as outlined in Section 7.


3. Information We Collect

Through SMS communications, the Company may collect:

  • Mobile phone number
  • Message content sent or received
  • Metadata such as date/time of messages
  • User responses to Company communications

The Company does not request or require sensitive personal information (e.g., SSN, banking info) through SMS and asks Users not to send such information by text.


4. How We Use SMS Information

The Company uses SMS information only for legitimate business purposes, including:

  • Communicating time-sensitive employment information
  • Emergency or safety-related notifications
  • HR and payroll functions
  • Recruitment logistics
  • Compliance with Company policies or legal obligations

SMS information will not be sold or used for marketing without explicit opt-in consent.


5. Data Sharing and Disclosure

The Company may share SMS data only with:

  • Authorized Company personnel who require access for business purposes
  • Service providers that support SMS delivery or data hosting
  • Government agencies or third parties as required by law, subpoena, or safety concerns

The Company does not sell SMS information to third parties.


6. Data Security

The Company takes reasonable administrative, technical, and physical measures to protect SMS data, including:

  • Restricted access to HR and management personnel
  • Secure systems for storing message logs
  • Vendor contracts requiring confidentiality and security protections

However, Users should understand that SMS is not a fully secure communication method.


7. Opt-Out and Withdrawing Consent

Users may opt out of non-mandatory SMS communications at any time by:

  • Replying “STOP” to any Company SMS, or
  • Contacting an HR Representative.

Certain employment-related notifications (e.g., emergency alerts, compliance notices) may still be sent when legally or operationally necessary.


8. Employee Monitoring Notice (Pennsylvania)

The Company may retain SMS logs sent through Company systems or devices for operational and compliance purposes. 

The Company does not monitor personal devices outside of Company-controlled applications or systems.


9. Data Retention

SMS information is retained only as long as necessary for business, compliance, or recordkeeping purposes, unless a longer period is required by law, Company policy, or litigation hold.


10. Employee Rights

Employees may request:

  • Access to SMS information maintained about them
  • Correction of inaccurate information
  • Information about how their data is used

Requests must be submitted to Melissa Grigas or Jennifer Masters. The Company will respond consistent with applicable law and Company policy.


11. Changes to This Policy

The Company may update this SMS Privacy Policy periodically to reflect changes in our practices or legal requirements. Users will be notified of material changes via email, SMS, or other standard communication methods.
