Schear Financial Services Applicant Privacy Policy
1. Purpose and Scope
This Schear Financial Services Applicant Privacy Policy (“Applicant Privacy Policy”) applies to all
persons making application for employment or other professional position, commercial relationship,
or business arrangement with Schear Financial Services or any affiliate, subsidiary, or related
entity of Schear Financial Services. This Applicant Privacy Policy addresses how the private
personal information of applicants will be used in the application and hiring process, how private
personal information will be protected, stored, and disposed of, and applicants’ privacy rights
regarding private personal information.
For purposes of this Applicant Privacy Policy, the terms “we”, “us”, “our”, “Schear Financial” or
the name of any affiliate, subsidiary, or related entity, or the like shall apply to Schear
Financial Services and/or the affiliate, subsidiary, or related entity to which application for
employment or other professional position, commercial relationship, or business arrangement is
being sought by the applying party(ies).
For the purposes of this Applicant Privacy Policy, the terms “you”, “your”, “applicant”,
“prospective employee”, or the like shall apply to the person, or to each person applying
collectively as a group, making application to Schear Financial for employment or other
professional position, commercial relationship, or business arrangement.
2. Types of Personal Information
In processing your application, you might provide and/or we might request, collect, or otherwise
obtain several types of personal information about you, including but not limited to those
enumerated below. Please note that some categories of information will only be requested,
obtained, or accepted by us upon your successful completion of certain stages of our selection
processes or upon your acceptance of an offer of employment.
• Information That You Provide to Us: You might provide us with information necessary to process
your application and reach an employment decision, which might include contact information (such as
name, mailing address, phone number, email address, etc.), relevant qualifications (such as
employment history, resume, curriculum vitae, cover letter, work experience, education,
transcripts, professional licenses, certifications, references, etc.), position information (such
as the type of employment sought, desired work environments, conditions, or terms, desired
compensation, availability, etc.), identification details and proof of employment eligibility (such
as state-issued identification, passport, immigration documents, etc.), and any other relevant
information you might submit to us or that we might request from you during the application
process.
• Information That We Obtain from Other Sources: We may also obtain information about you from
other sources such as recruiters, human resource or market research providers, identity
verification services, information publicly available through professional organizations and
directories, networking websites, social media, and the like, or other sources of our choosing to
the extent relevant and permitted by applicable law.
• Data Automatically Collected Through Information and Communications Technology: If you
send email or attachments to us, apply online through a web browser, upload files to us, etc., your
communications might also include metadata applicable to the technology used. For example, emails
or materials entered or uploaded online might contain the internet protocol (IP) address from which
an email was sent or from where a browser connected, the email client or browser used along with
the version, operating system, language preferences, and other information about the software or
the device used, as well as other metadata that might be included with or inferable from your
communications and any files uploaded or attached, from cookies placed by web sites and browsers,
and the like.
3. Accuracy and Consent Regarding Information that You Provide
You are solely responsible for ensuring that all information you provide to us is accurate,
truthful, and complete.
When providing the contact details and any other information regarding references or other third
parties whom we might contact in processing your application, it is your responsibility to obtain
the consent of all such third parties for us to contact them regarding your application before you
provide their information to us. By providing their contact information to us, you are affirming
that you have obtained their consent for us to contact them about your application, and you are
consenting to us contacting them about your application.
4. How Your Personal Information Is Used
We will use your personal information for purposes related to our hiring and onboarding processes
such as to process your application(s) for employment, to arrange a background check if you accept
an offer of employment, to facilitate a medical evaluation if you accept a position that includes
medical fitness-for-duty requirements, to comply with all applicable legal and regulatory
requirements, and for other business purposes as permitted by applicable law. Such uses of your
personal information will generally include the following:
• Processing your application and all related information in order to reach a decision regarding
your application, such as reviewing your qualifications and experience as well as your eligibility
for employment, contacting your references, communicating with you to seek additional information,
arrange interviews, and the like, conduct skills, language, and other assessments as applicable,
verify or assist with immigration and visa requirements if applicable, and to complete employment
onboarding and benefits enrollment if you accept an offer of employment.
• Complying with all applicable legal and regulatory requirements, such as any required record
keeping and reporting regarding our hiring practices or employment decisions, ensuring compliance
with equal-opportunity, non-discrimination, and similar requirements, and in connection with any
legal claims or actions.
• Furthering our own business purposes such as ensuring compliance with our internal employment,
information security, data privacy, and similar policies, practices, and procedures as well as
protecting our intellectual property and proprietary information regarding our business operations,
practices, plans, partners, customers, vendors, and the like.
• Creating your beginning personnel file and facilitating onboarding arrangements if you are
offered and accept a position with us.
Please note that any background check, or medical evaluation for positions with medical fitness-
for-duty requirements, will be required only after we have tendered and you have accepted an offer
of employment conditional upon a satisfactory background check or medical evaluation.
5. Sale or Disclosure of Your Personal Information
Schear Financial does not sell or otherwise permit unrelated third parties to access your personal
information. If, however, Schear Financial or the subsidiary, affiliate, or other entity to which
you applied should undergo a reorganization or similar process resulting in modification of
business operations and human resources or should be acquired by, merge with, or acquire another
entity, your personal information as an applicant or an employee might be shared with whatever
resulting entity(ies) assume management and control of the position for which you are applying or
the employment position or other arrangement you hold.
Schear Financial might also release your personal information to authorized entities if required by
operation of law or legal process, including applicable legal or regulatory disclosures and
reporting, compliance with investigative or audit requests from regulatory or law-enforcement
agencies, if compelled by court order, subpoena, or other civil or criminal process, or the like.
6. Security, Retention, and Disposal of Your Personal Information
Schear Financial maintains comprehensive technical, physical, and administrative safeguards to
protect the personal information of its applicants and employees against unauthorized access,
disclosure, aggregation, alteration, or destruction. Schear Financial will retain your personal
information only as long as necessary to evaluate your application for employment, to defend
against any relevant claims made against us or to pursue any claims we may have, and to comply with
all applicable legal and regulatory requirements.
If you are not offered a position of employment, decline to accept an offer of employment, or
withdraw your application during processing, we might retain your personal information for limited
purposes over a limited period of time as required or permitted by applicable legal and regulatory
requirements. If you accept an offer of employment with us, relevant personal information from the
application, hiring, acceptance, and onboarding processes will be included in your personnel file.
7. Privacy Rights Regarding Your Personal Information
If you have applied for a position with Schear Financial and shared private personal information
with us, you are entitled to request a copy of the personal information you have provided to us and
contents or descriptions of personal information that we have obtained about you outside of
proprietary or confidential sources and to request descriptions or explanations of our policies,
practices, and procedures regarding our collection, storage, use, disclosure, or destruction of
your personal information. You may also request to update, correct, amend, restrict, or delete your
personal information and otherwise have the right to object to our continued processing of your
personal information or to withdraw your consent for us to do so at any time, such as if you choose
to withdraw your application for employment or reject an offer of employment.
Please note that your rights may be limited in some instances, such as if fulfilling your request
would reveal personal information about another person or our confidential or proprietary
information or intellectual property, if you ask us to delete information which we are permitted or
required to retain by applicable law, or in other circumstances.
8. Effective Date and Changes to This Policy
This policy is effective upon publication and was last reviewed on June 30, 2025. Schear Financial
reserves the right to update or modify this policy at any time without prior notice and any such
update or modification shall become effective immediately upon publication.
