At A&W Restaurants, Inc., we are committed to protecting your privacy, and this Privacy Policy ("Policy") will help you understand how we collect and process Personal Information from those who apply to any of our open positions. This Policy also describes what we will and will not do with the information we collect, as well as your choices about the collection and use of your information. 


 

This Policy applies to Personal Information collected or used by A&W Restaurants, Inc. concerning the application process and subsequent employee information. "Personal Information" generally means any information that enables us to identify you, directly or indirectly, by reference to an identifier such as your name, identification number, location data, online identifier, phone number, social security number, or one or more factors specific to you. Personal Information can include "Sensitive Personal Information" (particularly sensitive types of Personal Information) and "Pseudonymised Personal Information" (information that does not identify you directly but can be linked to other information that does). Personal Information does not include anonymous information or information that has had the identity of an individual permanently removed. Note that privacy laws apply different definitions to "Personal Information" in various jurisdictions and contexts, and we may therefore need to apply a particular definition in specific circumstances. 


 

We may receive Personal Information through applying for a position within the company, and/or during the onboarding and employment lifecycle. We may receive this information directly from you, both online (e.g., our websites, email) and offline (e.g., phone);

  • From a previous employer, such as during a reference check;
  • From other third-party sources, such as our background check vendor;
  • Directly from you, via the application, onboarding, and employment process;
  • By combining information from different sources, including online and offline data.
     

You may provide Personal Information to us which may include your name, home and/or work email address, postal address, phone number and/or fax number, your previous employers, job titles, job descriptions, background check results, education, certifications and any other information required to verify qualifications and assess suitability for an available position. You may also provide your demographic information, including birth year, certification designation, etc., and banking information for direct deposits. A&W Restaurants, Inc. is also privy to your username, password, and any activity stored within the HR software. 


                    A&W Restaurants, Inc. may also ask for your voluntary participation in a survey for feedback and improvement processes.
 

We use Personal Information to recruit, contact, and evaluate candidates. We may also use Personal Information for the following purposes:

  • To update your profile with information provided by you;
  • To update and/or reset user accounts;
  • To contact and arrange interviews, screenings, and phone calls;
  • To respond to your questions;
  • For our business purposes, such as data analysis, audits, enhancing our website and/or HR software, improving our recruiting and retention policies, identifying trends, and determining the effectiveness of our recruitment campaigns;
  • To notify you about changes to your application status, send rejections or offer letters; 
  • To enable you to complete a survey;
  • To administer our recruiting site (including troubleshooting, data analysis, testing, system maintenance, support, reporting, and hosting of data);
  • To process your employment application, including background checks and education and employment verification, as applicable;
  • To comply with all applicable laws, legal processes, and industry standards, our policies and our contractual rights; and
  • For any other purpose specified at the collection point or as described in your express authorization.

Without restriction, we may use and disclose non-personal, non-individual statistics or demographic information in a de-identified or aggregate form.


               Information provided in an application for employment with A&W Restaurants, Inc. may be disclosed as reasonably necessary to verify past education and employment qualifications, perform background checks, and as otherwise required by law or A&W policy. 


 

A&W Restaurants, Inc. does not disclose sensitive Personal Information such as passcodes, social security numbers, bank account information, conviction information, or health information except as necessary to complete transactions requested by you, to process employment applications, or to comply with legal obligations, all under availability, confidentiality, and security protections. 


 

We offer you certain choices about what information we collect from you, how we use and disclose the information, and how we communicate with you.

  • Accessing and Correcting your Personal Information: If you are an applicant or have an employee account with us, you can generally access or correct your information by logging in to your account. If you are unable to do so you, can make a request by contacting A&W Restaurants, Inc. as directed below. 
  • Opting-Out of Text Messages: If you affirmatively consent to receive text messages from us and enroll in such a program, you may receive updates via text unless you opt-out of the text message program. These messages may be unencrypted. Message frequency may vary based on the Services. If at any time you would like to stop receiving text message notifications, please communicate this to you recruiter and specify your preferred method of communication. 
  • Limited Required Information: Where it is reasonable and possible, A&W Restaurants, Inc. has left it's application fields as optional. It is your choice how much information you choose to share with us. 
  • Removal of Information: If you would like your information removed from our application system and subsequent storage, contact us as directed below. 

 We may not, and will not, discriminate against any individual for exercising their privacy rights, including those provided by the applicable privacy laws. 


 

We maintain reasonable security safeguards designed to protect information in our possession and control, and to protect such information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, we cannot ensure the security of any information that you transmit to us, or guarantee that this information will not be accessed, disclosed, altered, or destroyed. We will make any legally required disclosures in the event of any compromise of Personal Information. To the extent the law allows us to provide such notification via email or conspicuous posting on the Services, you agree to accept notice in that form.


 

You are ultimately responsible for the security of your login credentials. You may not share your login credentials with colleagues or friends so they can access content or features that are restricted to applicants and employees only. You should log out of your browser at the end of each computer session to ensure that others cannot access your Personal Information and correspondence, especially if you share a computer with someone else or are using a computer in a public place like a library or Internet cafe.
