This Candidate Recruiting & Text Messaging Privacy Policy (“Privacy Policy”) describes how Lotus Concepts Management and its affiliated, related, subsidiary, commonly managed, or commonly owned companies and brands (collectively, the “Company,” “we,” “us,” or “our”) collect, use, maintain, and protect information provided by job applicants and prospective employees during the recruiting and hiring process.

For purposes of this Privacy Policy, the Company includes Lotus Concepts Management and its affiliates and related entities, including entities operating under or associated with the ViewHouse, My Neighbor Felix, Belle’s & Boots, Wonderyard Garden + Table, and Noble Steakhouse brands, as well as their respective affiliated, related, subsidiary, parent, management, and operating entities.

This Privacy Policy applies to candidates applying for or being considered for employment with any of these companies, brands, locations, or affiliated entities.

  • Name and contact information, including telephone number, email address, and mailing address;
  • Resume, employment history, education, qualifications, certifications, and other application information;
  • Positions and locations for which you apply or are considered;

Additional information may be collected during later stages of the hiring process as permitted or required by applicable law.

Candidates should not send sensitive personal information, such as Social Security numbers, banking information, passwords, medical information, or copies of government identification, through SMS/text messaging unless specifically directed to provide information through an authorized and secure method.

3. How We Use Candidate Information

We may use candidate information for legitimate recruiting, hiring, employment, administrative, legal, and business purposes, including to:

  • Review and evaluate applications and qualifications;
  • Communicate regarding job opportunities;

4. Recruiting Text Messages and Candidate Consent

The Company may use SMS or MMS text messaging to communicate with candidates regarding recruiting, hiring, interviews, applications, employment opportunities, and related matters.

Where required, candidates will be provided an opportunity to consent to receiving recruiting-related text messages. Providing a mobile telephone number does not require a candidate to consent to text messaging where consent is otherwise required by applicable law.

Recruiting text messages may include interview scheduling or confirmations, reminders, application updates, requests for follow-up, information about positions for which a candidate has applied or expressed interest, and other communications relating to the recruiting or hiring process.

Message frequency will vary depending upon your application, the position, and the stage of the recruiting process. Message and data rates may apply.

The Company does not use candidate SMS consent to send unrelated consumer marketing or promotional text messages.

5. Opting Out of Text Messages

You may withdraw your consent to receive recruiting-related text messages at any time by replying STOP to a text message.

After you opt out, you may receive one final message confirming your opt-out. We will then discontinue SMS communications to that number unless you subsequently request or consent to resume text communications.

You may reply HELP for assistance where that functionality is available.

Opting out of text messaging will not affect your ability to apply for employment, your application status, or your consideration for employment. We may continue to communicate with you through email, telephone, the recruiting platform, or other appropriate methods.

6. No Sale or Marketing of Candidate Mobile Information

We do not sell or rent candidate personal information, mobile telephone numbers, or SMS consent information.

Mobile information and SMS opt-in consent collected for recruiting communications will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

Information may be disclosed to service providers acting on our behalf when reasonably necessary to provide recruiting, applicant tracking, communications, information technology, background screening, onboarding, legal, or other services associated with the recruiting and hiring process. Such disclosure does not authorize those providers to use candidate information for their own independent marketing purposes.

7. Recruiting Technology and Service Providers

We may use third-party technology providers, including Paylocity and other authorized service providers, to administer applications, maintain candidate records, facilitate recruiting communications, and send or receive recruiting-related text messages.

Candidate information and communications may therefore be processed or stored within systems operated by authorized service providers on our behalf.

We may also disclose information when required by law, regulation, subpoena, court order, governmental request, or when reasonably necessary to protect the rights, safety, property, or legal interests of the Company, our applicants, employees, or others.

8. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect candidate information against unauthorized access, use, alteration, or disclosure.

Access to candidate information is generally limited to individuals and service providers who have a legitimate business need for the information in connection with recruiting, hiring, human resources, management, legal, administrative, or related functions.

No electronic system or method of communication can be guaranteed to be completely secure, and candidates should avoid transmitting highly sensitive or confidential information through ordinary text messages.

9. Data Retention

Candidate information and recruiting communications may be retained for as long as reasonably necessary for recruiting and hiring purposes, to maintain appropriate business and employment records, to consider candidates for future opportunities where appropriate, and to comply with applicable legal, regulatory, recordkeeping, and dispute-resolution requirements.

Information may be deleted or anonymized when it is no longer reasonably necessary for these purposes, subject to applicable legal and business requirements.

10. Candidate Choices and Requests

Candidates may contact us regarding questions about their recruiting information, to request correction of inaccurate contact information, or to communicate preferences regarding recruiting communications.

Certain rights regarding personal information may also be available under applicable federal, state, or local law. We will respond to applicable requests as required by law.

11. Changes to this Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our recruiting practices, technology, legal requirements, or business operations. The effective date above will identify the current version of this Privacy Policy.

Continued participation in the recruiting process following an update does not waive any rights or consents that applicable law requires us to obtain separately.
