Privacy Policy Notice for Job Applicants/Employees/Visitors to Elder’s Website – Colorado

Effective Date: June 1, 2025

Elder Construction, Inc. (“Elder”) is committed to protecting the privacy and rights of individuals who apply for employment with Elder (“Applicants”), are employed by Elder (“Employees”), and those who visit our Website or receive marketing information from us via email (“Visitors”). This Privacy Policy explains Elder’s policies relating to the collection, use, disclosure and protection of personal data provided to Elder by Applicants and Employees and provides notice to Visitors regarding applicable privacy policies related to our Website and email communications.

1.  Information We Collect

As part of the application and employment process, Elder may collect some or all of the following categories of Applicants/Employees’ personal data:

  • Identifiers: Full name, email address, phone      number, address, and other contact details
  • Employment      History: Resume/CV, job      history, references
  • Education      Information: Degrees, certifications, institutions attended
  • Sensitive      Personal Data: Race, ethnicity, veteran status, disability status, and other      demographic data collected for equal opportunity reporting
  • Biometric      Identifiers: Fingerprints, voiceprints, facial recognition data, iris scans, or      other unique biological, physical, or behavioral characteristics used for      identification purposes

2.  Biometric Data

Elder may collect and use an Employee’s biometric data for access control (i.e., to permit access to secure physical locations or technologies), attendance monitoring, and/or workplace safety. If Elder collects or uses an Employee’s biometric data for those purposes, before doing so, Elder will:  (1) obtain the Employee’s express consent; and (2) provide the Employee with a clear and concise notice detailing the types of biometric data collected, the reasons for collecting the biometric data, the duration for which such data will be stored, and whether biometric data will be shared with third parties. Elder will obtain additional explicit Employee consent if such biometric data is used for any purpose(s) other than those listed in the notice.

3. Age-Related Information

Employers are prohibited from requesting or requiring Applicants to disclose age-related information on an initial employment application except as directly related to public or occupational safety or if required by federal, state or local laws or regulations. Unless required for those purposes, Elder will not ask for that information. If Elder requires additional application materials, such as transcripts or certifications, Elder will inform Applicants that they may redact information identifying their age, date of birth, or dates of attendance at or graduation from an educational institution.

4.  Criminal History

Elder does not inquire about an Applicant's criminal history on an initial employment application or state in an application or advertisement that a person with a criminal history may not apply for the position. Elder may inquire about criminal history at later stages of the hiring process and will do so in compliance with applicable laws and regulations.

5.  Data Security/Retention

Elder has instituted administrative, technical, and physical safeguards to protect personal data, including biometric data. However, no method of transmission or storage is 100% secure. Elder retains personal data only as long as necessary to fulfill the purposes outlined in this policy or as required by law.

6.  Visitors to Elder’s Website/Elder’s Email Marketing

Visitors should follow this link privacy@paylocity.com to review the separate privacy policy regarding information that may be collected when interacting directly with Elder via our Website. Visitors who contact Elder solely as a private consumer (not as a member or representative of a company or other organization) are entitled to consumer privacy rights. Visitors who reside in Colorado, for example, have the right to: 

  • Access your personal data
  • Correct inaccuracies in your      personal data
  • Delete certain personal data,      subject to legal and business exceptions
  • Opt out of processing of personal      data for profiling or automated decision-making

Elder will not discriminate against anyone for exercising their consumer rights and will respond to verifiable requests within 45 days. Elder also uses “cookies” on our Website. 7. Changes to This Policy

Elder may modify, alter, or update this Privacy Policy from time to time without prior notice. Any changes will be posted on our website with the updated effective date.
