Candidate Privacy Policy & SMS/Text Messaging Notice

This Candidate Privacy Policy and SMS/Text Messaging Notice (“Policy”) explains how OPS Living (“we,” “us,” or “Company”) collects, uses, discloses, and protects personal information about job applicants and candidates (“you” or “Candidate”) through our human resources information system (“HRIS”), including when we communicate with you by text message (SMS/MMS). By providing your phone number to us or by opting in to text communications, you agree to the terms of this Policy.

1. Scope

This Policy applies to personal information we collect about you during recruiting and hiring, including through our applicant tracking / HRIS platform, careers site, phone calls, email, and text messaging. It does not apply to information we collect about current or former employees under a separate employee privacy notice, or to visitors of our general website who are not applying for a role.

2. Information We Collect

Depending on how you interact with us, we may collect:

  • Identifiers and contact information — name, mailing address, email address, and mobile phone number.
  • Application materials — resume/CV, cover letter, work history, education, certifications, and references.
  • Recruiting communications — records of emails, calls, and text messages exchanged with our recruiters, including message content, timestamps, and delivery/consent status.
  • Interview and assessment information — interview notes, scheduling details, and any assessment or test results you complete.
  • Technical information — IP address, device/browser type, and activity on our careers site or candidate portal.
  • Information required by law — e.g., work authorization or equal-opportunity survey responses you choose to provide.

3. SMS / Text Messaging Communications

3.1 Consent (Opt-In)

By providing your mobile phone number in our HRIS, careers portal, or application form and checking the applicable consent box (or otherwise affirmatively opting in), you consent to receive recruiting-related text messages from OPS Living and its texting service provider, at the mobile number provided. These messages may include interview scheduling, application status updates, requests for documents, offer-related communications, and other recruiting-related notices.

Consent is not a condition of employment or of consideration for any position. You may still apply and be considered for a role without opting in to text messaging; alternative contact methods (email or phone) will be used instead.

3.2 Message Frequency, Rates, and Carriers

  • Message frequency varies based on your application status and recruiting activity.
  • Message and data rates may apply. Check with your mobile carrier for details.
  • Carriers are not liable for delayed or undelivered messages.

3.3 How to Opt Out

You may withdraw consent at any time by replying STOP to any text message we send, or by contacting us using the information in Section 10. After you opt out, we will send one confirmation message and then stop sending recruiting texts, though we may still contact you by email or phone regarding an active application. Reply HELP for assistance, or contact us directly.

3.4 Categories of Text Messages

  • Application receipt confirmations and status updates
  • Interview scheduling, reminders, and rescheduling
  • Requests for additional documents or information
  • Offer and onboarding-related communications
  • We do not use recruiting text messages for unrelated marketing or promotional purposes.

4. How We Use Your Information

  • Evaluate your qualifications and manage the hiring process
  • Communicate with you about your application, including via text message where you have opted in
  • Schedule and coordinate interviews and assessments
  • Verify eligibility to work and conduct background checks where legally permitted and disclosed separately
  • Comply with legal, regulatory, and record-keeping obligations
  • Improve our recruiting processes and HRIS platform

5. How We Share Your Information

We share candidate information only as needed to operate our recruiting process, including with:

  • Our HRIS and applicant-tracking software providers, who process data on our behalf
  • Our SMS/text messaging platform provider, [SMS Platform/Vendor Name], solely to deliver and log recruiting text messages
  • Hiring managers and interview teams involved in your candidacy
  • Background check or reference verification vendors, where applicable and separately authorized
  • Professional advisors and regulators, where required by law
  • We do not sell your personal information, and we do not share your mobile number with third parties for their own marketing purposes.

6. Data Retention

We retain candidate information, including text message records, for as long as reasonably necessary to evaluate your application, comply with legal obligations and defend against potential claims. If you are hired, relevant records may be transferred to your employee file under our Employee Privacy Notice.

7. Your Rights and Choices

Depending on your location, you may have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your information, subject to legal retention requirements
  • Opt out of text messaging at any time (see Section 3.3)
  • Withdraw consent to processing, where consent is the basis for processing
  • To exercise these rights, contact us using the details in Section 10. Residents of certain states (e.g., California, Colorado, Connecticut, Virginia) may have additional statutory rights under applicable state privacy law; see Section 9.

8. Data Security

We use administrative, technical, and physical safeguards designed to protect candidate information from unauthorized access, disclosure, alteration, or destruction, both within our HRIS and with our text messaging vendor. No system is completely secure, and we cannot guarantee absolute security. In the event of a data security incident affecting your personal information, we will provide notification as required by applicable law, including Indiana's breach notification statute (Ind. Code Art. 24-4.9) for Indiana residents.

9. State-Specific Notices

If you are a resident of California, Colorado, Connecticut, Virginia, Utah, or another state with an applicable consumer privacy law, you may have additional rights, including the right to know, delete, correct, or limit use of certain personal information, and the right to non-discrimination for exercising these rights.

9.1 Indiana Residents

The Indiana Consumer Data Protection Act (Ind. Code Art. 24-15), effective January 1, 2026, generally applies to personal data processed in a consumer (personal, family, or household) context and excludes data processed in an employment context, such as candidate and recruiting data. OPS Living therefore does not currently treat candidate data as subject to that Act. If our processing of Indiana candidate data changes in a way that could implicate the Act, we will update this notice accordingly. Text messages to Indiana candidates are sent only with your prior opt-in consent, consistent with Indiana's telephone solicitation and automatic-dialing statutes (Ind. Code § 24-5-12 and § 24-5-14). Opt-out requests are honored immediately upon receipt of STOP.
