Last Updated: July 28, 2025

1. Introduction and Scope

Arise Staffing, Inc. ("Arise Staffing," "Company," "we," "us," or "our") provides candidate texting services to facilitate efficient communication with job candidates regarding employment opportunities. This policy governs our collection, use, and protection of personal information through our SMS text messaging program. By opting into our texting program, you consent to receive automated text messages from Arise Staffing in accordance with this policy and applicable law.

For purposes of this policy, SMS or text messages refer to Short Message Service communications sent to your mobile device. A candidate is any individual who has applied for employment or expressed interest in job opportunities with Arise Staffing. Opt-in means your express written consent to receive text messages from us, and personal information includes any information that identifies or relates to you personally.

2. Information We Collect

When you participate in our texting program, we collect and process information that you provide directly to us as well as information that is automatically generated through our communications. The information you provide includes your full name and contact information, mobile phone number, employment preferences and availability, responses to our text messages, and any additional information you share via text during our communications.

We also automatically collect certain technical information when you participate in our texting program. This includes message delivery and read receipts, timestamps and dates of messages, mobile carrier information, device type and operating system when available, and general location data such as your geographic area when this information is available through your mobile service.

3. How We Use Your Information

We use your information solely for legitimate business purposes related to our recruitment and employment processes. This includes sending you recruitment communications such as job opportunity notifications, application status updates, and employment-related announcements. We also use your information for interview coordination, including scheduling, rescheduling, and confirming interviews and appointments.

Your information helps us share important documents with you, including forms, contracts, onboarding materials, and other employment-related documents. We use the information for process management purposes such as confirming your interest in positions, checking your availability, and managing your candidate profile in our systems. Additionally, we may use your information to meet our legal and regulatory compliance requirements and to analyze communication effectiveness to improve our services.

4. Consent and Opt-In Requirements

Our texting program complies with the Telephone Consumer Protection Act (TCPA) and other applicable regulations governing text message communications. You may provide consent to participate in our texting program through several methods, including online application portals with clear consent checkboxes, digital forms with explicit texting authorization, written consent forms, documented verbal consent with confirmation, or by replying to initial opt-in verification messages we send to you.

After you opt in to our program, you will receive a confirmation message that explains the program and provides information about how to opt out if you choose to do so. You may receive up to 10 messages per month from us, though the actual frequency may vary based on active job opportunities and your level of engagement with our recruitment process. Please note that standard message and data rates may apply according to your mobile carrier plan, though we do not charge any additional fees for our messages.

5. Opt-Out Procedures

You can opt out of our texting program at any time by replying to any of our messages with specific keywords. These keywords include STOP, QUIT, CANCEL, UNSUBSCRIBE, or END. Your opt-out request will be processed within one business day of receiving it, and you will receive a final confirmation message letting you know that you have been successfully removed from our texting program.

If you decide you want to receive text messages from us again after opting out, you will need to complete the entire opt-in process again through our official channels. If you need assistance with our texting program, you can reply HELP to any message to receive contact information and support details.

6. Data Sharing and Third-Party Providers

We use Paylocity as our primary platform for managing candidate communications. Paylocity maintains industry-standard security protocols and privacy practices, and their privacy policy is available at https://www.paylocity.com/company/protecting-our-clients/privacy-center/ for your review. We may share your information with authorized service providers who assist with our texting program, legal authorities when required by law, and business partners involved in specific job opportunities, but only with your consent.

We want to be clear that we do not sell, rent, or trade your personal information to third parties for marketing purposes. Any sharing of your information is limited to the specific purposes outlined in this policy and is done in accordance with applicable privacy laws and regulations.

7. Data Security and Protection

We implement appropriate technical and organizational measures to protect your personal information from unauthorized access, use, or disclosure. These measures include encrypted data transmission and storage, access controls that limit who within our organization can view your information, regular security assessments and updates to our systems, comprehensive staff training on data protection practices, and established incident response procedures for potential data breaches.

While we take these security measures seriously and work to protect your information, no method of electronic transmission or storage is completely secure. We encourage you to also take steps to protect your personal information, such as keeping your mobile device secure and not sharing sensitive information through text messages unless necessary.

8. Data Retention

We retain texting-related data for different periods depending on your status and our legal obligations. For active candidates, we keep your information throughout your application process and for up to two years after your last interaction with us. We also retain information as required by applicable employment and privacy laws, and we may retain information longer when necessary for legal proceedings until those matters are resolved.

Once the applicable retention period expires, we securely delete your information unless longer retention is specifically required by law. Our data retention practices are designed to balance our legitimate business needs with your privacy interests and legal requirements.

9. Your Privacy Rights

Depending on your location, you may have various rights regarding your personal information. These may include the right to request access to copies of personal information we hold about you, the right to request correction of inaccurate or incomplete information, the right to request deletion of your personal information subject to legal requirements, the right to request that your information be transferred to another service, the right to request limitations on how we process your information, and the right to object to processing of your information for certain purposes.

We will respond to your request in accordance with applicable law.

10. International Considerations

If you are located outside the United States, please be aware that your information may be transferred to and processed in the United States, where our servers and service providers are located. The United States may have different data protection laws than your country of residence. By participating in our texting program, you consent to this transfer and processing of your information in the United States.

11. Policy Updates

We may update this policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors that affect how we handle your personal information. When we make material changes to this policy, we will notify you through text message if you are an active participant in our program, by posting the updated policy on our website with a revised effective date, and by email when we have your email address available.

Your continued participation in our texting program after we post or send notice of policy updates constitutes your acceptance of the revised terms. We encourage you to review this policy periodically to stay informed about how we protect your information.
