This Applicant Privacy Policy describes how RedGuard LLC, LANGE Shared Services, and RGDS (collectively, the “LANGE Companies,” “Company,” “we,” “us,” or “our”) collect, use, disclose, and retain personal information from job applicants in any U.S. state.

Each LANGE Company is a separate legal entity. However, recruiting systems, human resources platforms, administrative services, and certain service providers may be shared across the LANGE Companies.

This Policy applies to all applicants who apply for employment with any of the LANGE Companies through our websites, applicant tracking systems (ATS), text messaging, email, phone communications, or other recruiting channels.



1. Personal Information We Collect

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device ("personal information"). Personal information does not include:

· Publicly available information from government records.

· De-identified or aggregated consumer information.

· Information excluded from the CCPA's scope, like:

· health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;

· personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.


In particular, we have collected the following categories of personal information from its consumers within the last twelve (12) months: 

   

Category - Examples

 

A. Identifiers - A real name, alias, postal address,   unique personal identifier, online identifier, Internet Protocol address,   email address, account name, Social Security number, driver's license number,   passport number, or other similar identifiers.

 

B. Personal information   categories listed in the California Customer Records statute (Cal. Civ. Code   § 1798.80(e)). - A name, signature, Social Security   number, physical characteristics or description, address, telephone number,   passport number, driver's license or state identification card number,   insurance policy number, education, employment, employment history, bank   account number, credit card number, debit card number, or any other financial   information, medical information, or health insurance information.

Some personal information included   in this category may overlap with other categories.

 

C. Protected classification   characteristics under California or federal law. - Age (40 years or older), race,   color, ancestry, national origin, citizenship, religion or creed, marital   status, medical condition, physical or mental disability, sex (including   gender, gender identity, gender expression, pregnancy or childbirth and related   medical conditions), sexual orientation, veteran or military status, genetic   information (including familial genetic information).

 

D. Biometric information. -  Genetic, physiological, behavioral,   and biological characteristics, or activity patterns used to extract a   template or other identifier or identifying information, such as,   fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke,   gait, or other physical patterns, and sleep, health, or exercise data.

 

E. Internet or other similar   network activity. - Browsing history, search history,   information on a consumer's interaction with a website, application, or   advertisement.

 

F. Geolocation data. - Physical location or movements. 

 

G. Professional or   employment-related information. - Current or past job history or   performance evaluations.

 

H. Inferences drawn from   other personal information. - Profile reflecting a person's   preferences, characteristics, psychological trends, predispositions,   behavior, attitudes, intelligence, abilities, and aptitudes.



2. How We Collect Information


We collect personal information:

  • Directly from you (e.g., job applications,      interviews, forms).
  • From third parties (e.g., references, background      check providers, recruiting platforms).
  • Automatically through our website or applicant      tracking systems.
  • Through text messaging communications related to      recruiting.

3. How We Use Applicant Information

We may use applicant personal information to:

  • Evaluate qualifications and eligibility for      employment.
  • Schedule interviews and communicate application      status.
  • Conduct background checks or pre-employment      screenings (where authorized).
  • Verify employment eligibility.
  • Comply with federal, state, and local employment      laws.
  • Defend against legal claims.
  • Improve our recruiting processes.

We do not use applicant information for unrelated marketing purposes.


4. Text Messaging Communications (SMS/MMS)

If you provide a mobile phone number, we may communicate with you via text message for recruiting-related purposes, including interview scheduling, application updates, and onboarding coordination.

Consent

By voluntarily providing your mobile number, you consent to receive recruiting-related text messages. Message frequency may vary. Consent is not a condition of employment.

Opt-Out

You may opt out at any time by replying “STOP” to a message or contacting us at HC@thelangecompanies.com or (855) 733-4827.

Fees

Message and data rates may apply based on your carrier.

Sharing

We may use third-party service providers to facilitate text messaging. We do not sell mobile phone numbers or text messaging consent information.


5. Sharing of Applicant Information

We may share applicant information with:

  • Internal HR personnel and hiring managers.
  • Service providers (e.g., applicant tracking      systems, background screening vendors, communication platforms).
  • Government agencies where required by law.
  • Legal advisors when necessary.

All service providers are contractually required to safeguard personal information and use it only for authorized purposes.


We do not sell applicant personal information.


6. Data Retention

As a federal contractor, the LANGE Companies are subject to record retention obligations under federal, state, and local laws, including but not limited to:

  • OFCCP regulations
  • Equal Employment Opportunity (EEO) reporting      requirements
  • I-9 and employment eligibility laws
  • Wage and hour record retention requirements
  • Federal acquisition regulations (where      applicable)

Applicant information will be retained in accordance with applicable legal requirements and our internal record retention policies.


If you are hired, your applicant information may become part of your personnel file.


7. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect applicant personal information. However, no method of transmission or storage is completely secure.


8. Your Privacy Rights

Applicants may have certain rights under state privacy laws depending on their state of residence.


General Rights (Where Applicable)

Depending on state law, you may have the right to:

  • Request access to your personal information.
  • Request correction of inaccurate information.
  • Request deletion of certain personal information.
  • Request information about how your data is      shared.

We will verify your identity before processing any request.


9. Additional Rights for California Residents

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

These rights include:

  • The right to know what personal information we      collect and how we use it.
  • The right to request deletion of personal      information (subject to legal exceptions).
  • The right to request correction of inaccurate      information.
  • The right to data portability.
  • The      right not to be discriminated against for exercising your privacy rights.

Deletion Exceptions

We may deny deletion requests where retention is necessary to:

  • Comply with federal contractor record retention      requirements.
  • Comply with employment, tax, or legal      obligations.
  • Exercise or defend legal claims.
  • Detect      security incidents or prevent fraud.

10. Non-Discrimination

We will not discriminate against applicants for exercising privacy rights under applicable law.


11. Changes to This Policy

We may update this Applicant Privacy Policy from time to time. Updates will be posted with a revised effective date.
