This Notice of Privacy Practices for Job Applicants (“Applicant Notice”) describes how Sports Warehouse, Inc. and its subsidiaries and affiliates (“Sports Warehouse” “we,” or “us”) process information of applicants or candidates for employment (the “Applicants”) in connection with our recruiting activities.
Please read this Applicant Notice carefully because it explains important information about the processing of your personal information by Sports Warehouse, including your rights with respect to your personal information. 1. Information We Collect
When you apply for a job with us, we may collect certain information from and about you in order to evaluate and process that application. This information may include:
● Personal Details: Such as name, work and home contact details (telephone number, physical address, email), gender, date of birth, national identification number, social security number, and username;
● Documentation Required under Immigration Laws: Citizenship and passport data, details of residency or work permit;
● Talent Management Information: Such as details contained in letters of application and resume/CV (previous employment background, education history, professional qualifications, language and other relevant skills, certification, certification expiration dates), and information necessary to complete a background check ;
● Professional and other work-related licenses, permits, and certifications;
● Awards and professional memberships;
● Information Relating to References: such as names, titles, and contact information of references;
● Social Media: Information from social media sites; and
● Other Information You Provide: For example employment preferences, willingness to relocate, and desired salary;
Sensitive Personal Information: Certain types of information are considered sensitive personal information in certain jurisdictions. We may collect information on race, religion, ethnicity, nationality or national origin, age, gender identity, sex, sex life or sexual orientation, criminal convictions and offenses, marital status, medical or health information (including disability status), genetic or biometric information, religious or philosophical beliefs, political party or trade union membership, background check information, and veteran status.
You are responsible for the information you provide to Sports Warehouse and that it is honest, truthful, accurate, and not misleading in any way.
In addition to the information you provide to us, we may obtain information about you from other third parties, such as platforms used to collect application information, social media, recruiters, references, former employers, and law enforcement agencies.
To the extent permitted by applicable law, we may collect personal information obtained through a background check.
2. How We Use Information
The information collected during a job application process may be used for personnel recruitment, management, and planning purposes including the following:
● Reviewing your Application: Analyze your qualifications for the job you applied for or future jobs that may match your profile;
● Communication: Communicate with you regarding your job application, your inquiries and requests, other job openings, or important notices;
● Background Checks: We may conduct criminal history, background, and employment checks, if we offer you a position and where permitted by applicable law;
● Support our efforts to maintain a diverse workforce; and
● Compliance: Comply with or monitor our compliance with any applicable law or regulation.
We may use and disclose information in an aggregated or de-identified manner at our discretion, including for research, analysis, modeling, marketing, and improvement of our Services.
3. How We Disclose Your Information
We may disclose your information in the following circumstances:
● Vendors and Service Providers. We may share your information with vendors and service providers that we believe need the information to perform a technology, business, or other professional function for us, including providing products or Services to you or our clients on our behalf, creating or maintaining our databases, researching and analyzing the people who request information from us, preparing and distributing communications, or responding to inquiries.
● Affiliates. We may share your information with companies that we own or control, that are owned or controlled by us, or that are under common ownership or control.
● Business Transition. If Sports Warehouse, or any portion of our assets, are acquired by, merged with, transferred to, or invested in by another company, we may share your personal information with that company or other third parties involved in the business transition. We cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your information the same as described in this Policy.
● We share information where necessary to comply with applicable law, to respond to requests from law enforcement agencies or other government authorities or third parties, as permitted by law, and without your consent when it is necessary to protect our customers, employees, or property; in emergency situations; or to enforce our rights under our terms of service and policies.
4. California Consumer Disclosure
The California Consumer Privacy Act as amended by the California Privacy Rights Act (collectively, the “CCPA”) grants applicants certain privacy rights. If you are a resident of California, you may have the following rights:
● Right to know and access. You have the right to be informed about how your personal information is collected and processed. This Applicant Notice details how we collect, process, and disclose Applicants’ personal information in connection with our recruiting activities.
● Right to delete. An Applicant requesting deletion will result in us not being able to evaluate your candidacy or employ you.
● Right to correct inaccurate information. You may request we correct any information we maintain about you that you believe is inaccurate.
● Right to non-discrimination. You have the right to non-discrimination for exercising your CCPA rights.
● Opt out of the ‘sale’ or ‘share’ of your personal information. We do not ‘sell’ or ‘share’ your personal information as defined by the CCPA.
● Limit the Use and Disclosure of Your Sensitive Personal Information. Sports Warehouse only collects Applicant sensitive personal information which is necessary to evaluate candidacy and for employment purposes. As such, limiting our use of your sensitive personal information would result in us not being able to evaluate your candidacy or employ you.

5. Retention & Disposal
We retain information as long as necessary to fulfill the purposes for which we collected it, for legitimate business reasons, or as required by law or in order to comply with a regulatory obligation.
6. Security
We implement the appropriate organizational, technical, and physical security measures and controls to protect the confidentiality, integrity, and availability of the personal information entrusted to us. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us at hr.us@warehousesports.com
7. International Data Transfers
Sports Warehouse is an organization established in the United States of America (USA). For individuals located outside the United States, your personal information will likely be transferred to, stored, and processed in the USA or other countries outside of where you live. When we conduct such transfers, we rely on various legal bases to lawfully transfer personal information, including the European Union Commission-approved Standard Contractual Clauses (SCCs) and the United Kingdom’s International Data Transfer Agreement (IDTA).

We reserve the right to modify, alter, or update the terms and conditions of this Applicant Notice from time to time without prior notice. We will post those changes on this page in addition to updating the “Last Updated” at the top of this webpage. Any material changes to this Applicant Notice will be communicated to you in advance of changes being implemented.
