Shakey’s USA Inc. (“Shakey’s,” “we,” “our,” or “us”) values your privacy and is committed to protecting the personal information you provide when applying for employment through our Applicant Tracking System (“ATS”).

This Applicant Privacy Notice explains how we collect, use, disclose, retain, and protect personal information from California job applicants, former employees reapplying for employment, and internship applicants who apply through our ATS powered by Paylocity.

This notice applies only to applicants applying for positions with Shakey’s USA Inc. in California. Franchise-owned locations maintain separate application processes and privacy practices.

1) Personal Information We Collect

During the application process, we may collect personal information including:

  • full name 
  • phone number 
  • email address 
  • mailing address 
  • employment history 
  • education history 
  • resume or uploaded supporting documents 
  • availability and scheduling preferences 
  • work authorization eligibility 
  • age eligibility confirmations (such as whether you are 18 years of age or older when required) 
  • position and location preferences 
  • interview notes and hiring feedback 
  • communication history related to your application 

Applicants may choose to upload a resume, which may be used by the ATS to auto-populate certain application fields.

After a conditional offer is accepted, we may collect additional information necessary for onboarding and legal compliance, including:

  • government identification information 
  • work authorization documentation 
  • criminal background screening data 
  • motor vehicle record information (for driving roles) 
  • E-Verify related information 
  • other legally required onboarding information 

Sensitive onboarding information is collected after offer acceptance, not during the initial application stage.

2) How We Use Your Information

We use applicant information to:

  • evaluate qualifications for a specific job opening 
  • communicate with you regarding your application 
  • schedule interviews 
  • coordinate manager review within the applicable hiring jurisdiction 
  • extend offers of employment 
  • complete onboarding steps 
  • conduct legally permitted background screening 
  • complete E-Verify and work authorization compliance 
  • support reporting, analytics, and workforce planning 
  • maintain records required by law 
  • defend legal claims and respond to government inquiries 

We do not use applicant information for unrelated marketing purposes.

3) Automated Eligibility Questions and Screening

As part of the application process, we may use objective yes/no eligibility questions to determine whether an applicant meets basic job requirements.

Examples may include:

  • whether you are at least 18 years old when the role requires it 
  • whether you are legally authorized to work in the United States 
  • whether you meet specific role-based eligibility requirements 

Applications that do not meet required eligibility criteria may be automatically flagged or rejected by the ATS before manager review.

These screening questions are based on job-related business requirements and may be overridden by authorized Human Resources personnel when appropriate.

Shakey’s does not currently use AI-based applicant scoring or ranking tools, but reserves the right to implement lawful screening tools in the future consistent with applicable law.

4) Communications

We may contact applicants through:

  • email 
  • phone calls 
  • text messages 
  • automated interview reminders 
  • Paylocity ATS messaging tools 

By providing your contact information, you consent to communications regarding your application and hiring process.

Applicants may also choose to opt in to future communications regarding employment opportunities.

5) Background Checks and Post-Offer Screening

After acceptance of a conditional offer, Shakey’s may conduct legally compliant post-offer screening, including:

  • criminal background checks 
  • motor vehicle record (MVR) checks for driving positions 

These screenings are completed only after a separate disclosure and authorization form is signed.

Background screening vendors provide legally required pre-adverse and adverse action notices when applicable.

We also use E-Verify after hire where legally required.

6) Cookies, Website Tracking, and ATS Analytics

Our careers page is integrated into the main Shakey’s website and may use:

  • cookies 
  • website analytics 
  • ATS usage analytics provided through Paylocity 
  • session and performance monitoring tools 

These technologies help us improve recruiting workflows, applicant experience, and reporting.

7) Who Can Access Applicant Information

Access to applicant information is limited to authorized personnel with a business need, including:

  • Human Resources 
  • Regional Managers 
  • General Managers 
  • store-level managers within their assigned jurisdiction 
  • authorized Paylocity service providers 
  • authorized background screening vendors 
  • legally required government verification services 

Franchise locations do not access Shakey’s USA Inc. applicant data through this ATS.

8) Data Retention

We retain applicant and hiring records for at least four (4) years from the date of application or the hiring decision, whichever is later, as required by California law. 

We may retain records longer when necessary for:

  • litigation holds 
  • government investigations 
  • legal claims 
  • internal audits 
  • compliance obligations 
  • legitimate business purposes 

Although applicants must apply separately for each open position, prior records may remain in our systems for legal retention and compliance purposes.

9) Your California Privacy Rights

California applicants may request:

  • access to the personal information submitted in connection with their application 
  • correction of inaccurate application information 
  • deletion of information, subject to legal retention obligations 
  • a copy of their submitted application materials 

To protect applicant privacy, we may require reasonable identity verification before processing a request.

Requests are reviewed and fulfilled by Human Resources.

10) No Sale or Marketing Use

Shakey’s does not sell applicant personal information.

We also do not use applicant information to create advertising audiences, marketing leads, or unrelated promotional campaigns.
